Federal family leave is generally unpaid. You may choose to use accrued paid leave at the same time, and if you do not, the employer may require it. The paid time follows the ordinary rules of that vacation or sick policy. If you skip the extra steps the policy uses for getting paid, you can lose the paycheck and still keep the unpaid leave. If neither you nor the employer uses paid leave, you keep the paid time you have earned.

Whether you and the employer qualify, and how disability law differs, is in workplace leave. Time off for treatment can qualify. Absence caused by use itself may not. The health plan can continue, and you still owe your share

During this leave the employer must keep group health coverage on the same terms as if you had kept working, including substance use treatment if the plan already covered it. A plan that did not cover treatment before you left does not gain that coverage because you went on leave. Benefits other than group health, such as a bonus, follow the policy the employer uses for other leave. Ask which written policy applies.

You keep paying the share you paid before. On unpaid leave, the employer chooses how that share is collected, may not add an administrative fee, and must give you the terms in writing ahead of time. An insurance policy you bought on your own, outside the group plan, is your bill to arrange.

Unless the employer already has a longer grace period, the duty to keep coverage stops when a premium is more than 30 days late. To drop coverage, the employer must mail written notice at least 15 days before it ends. Job restoration when you return is a separate duty and continues. If coverage lapsed because you did not pay, the employer must restore equivalent coverage when you come back, without a new waiting period or a medical exam as the price of returning. A state check is a different stack

When a state or local paid leave program is already paying you for leave that federal family leave also covers, neither you nor the employer may force accrued employer leave on top of that pay. If the state program replaces only part of your wages, you and the employer may agree, where state law allows, to use accrued leave to fill the gap. If you are not eligible for the federal leave, an employer may still allow unpaid time. Health coverage then follows ordinary leave-without-pay rules.
